This Release is effective on the date it is executed (“Effective Date”) by the participant
identified (the “Participant”) or by the parent or legal guardian (the “Guardian") of the Participant if under the legal age of consent, in favor of (i) Union Power Charitable Foundation, Inc., a North Carolina 501(c)(3) non-profit corporation, whose principle address is 1525 N. Rocky River Road, (ii) Union Electric Membership Corporation, a North Carolina 501(c)(12) non-profit rural electric cooperative of the same address, and (iii) each
corporation’s employees, officers, directors, agents and affiliates. (Collectively, (i) – (iii),
“UPCF”).
WHEREAS, UPCF has chosen to host a charitable fundraising event on November 13, 2026 (the “Event”) at Four Branches Sporting Preserve, LLC, a North Carolina limited liability
company, whose principal address is 425 Poplar Hill Church Road (“Four Branches”), and has invited the Participant to voluntarily participate in the Event; and
WHEREAS, the Participant has chosen to participate in the Event and is aware that the
activities performed by the Participant, or other members, guests, instructors, and staff,
whether associated with the Event or not, include using firearms on Four Branches’ property (the “Activities”); and
WHEREAS, the Participant understands that the Activities are hazardous, inherently dangerous, and could potentially result in serious injury or death and that as a shooter, spectator, or guest the Participant may be exposed to above-normal risks and agrees to follow the instructions of Four Branches’ officers, officials, and/or shooting range staff to minimize those risks; and
NOW, THEREFORE, the Participant hereby knowingly, freely, voluntarily, and without duress
agrees to the following terms of the Release.
1. Liability and Assumption of Risk. The participant does hereby release and forever
discharge and hold harmless UPCF (defined above to include (i) Union Power Charitable
Foundation, Inc., (ii) Union Electric Membership Corporation, and (iii) each corporation’s employees, officers, directors, agents and affiliates) from any and all liability, claims, and
demands of whatever kind or nature, including but not limited to, bodily injury, personal injury, illness, death, or property damage, either in law or in equity, which arise or may hereafter arise from participation in Activities during the Event, whether caused by negligence, or otherwise. The Participant expressly and specifically assumes the risk of injury or harm during the Event.
2. Photography. The Participant does hereby grant and convey unto UPCF all right, title,
and interest in any and all photographic images and video or audio recordings made by UPCF
during the Participant’s Activities at the Event, including, but not limited to, any royalties,
proceeds, or other benefits derived from such photographs or recordings.
3. Alternate Date. The Participant understands that the Event may be held on an alternate date due to inclement weather or other extenuating circumstances outside of UPCF control and that the terms of this Release will carry-over to that alternate date.
4. Other. The Participant expressly agrees that this Release is intended to be as broad
and inclusive as permitted by the laws of the State of North Carolina, and that this Release
shall be governed by and interpreted in accordance with the laws of the State of North
Carolina. Should any provision of this Release be held as invalid by any court of competent
jurisdiction, the invalidity of such shall not otherwise affect the remaining provisions of this
Release which shall continue to be enforceable.
IN WITNESS WHEREOF, the Participant, or the Guardian when required, has executed this
Release as of the day and year first written below.
